The Marshal searched for and captured Kate for the murder of her biological father, Wayne. The Marshal was escorting Kate back to the states on Flight 815 when the plane went down. He survived the crash, but had extensive injuries. He was able to communicate to Jack that Kate was his prisoner before he died.
